HSBC PPI -this may be tricky

    Yes they have enclosed a copy of the FOS complaints booklet ans supplied contact details for the FOS. So do I now move to the "Stage 2. Now threaten the Ombudsman" or goto "Stage 3. If all else fails complain to the FOS" ?.

    You have a deadlock letter now. So, the threat of the FOS wont matter. They are saying that you have their answer and if you dont like it then you go to the FOS.

    Hi there

    It seems like they are not going to budge, if you want to give it another go its up to you, but if you hear nothing by 14 days, I would say then defo move on to the FOS.
    You can ring the FOS to request they post you a complaints form or download and print the form from their website, remember as well to enclose a copy of the final correspondence.

    Do you have a copy of the letter from HSBC rejecting your complaint three years ago?

    Does it actually tell you that you have only six months to take the complaint to FOS?

    If not, and it is dated prior to 1 November 2007, then you should still have the right to take it to FOS. This is because, at that time, FSA Rule DISP 1.4.12(1) required their final response to tell you that you had six months. If it didn't then FOS should still accept it.

    If it was after that date they may still do so - particularly if you were not given a copy of the FOS booklet.

    I am not disagreeing with DunstonH in that, if HSBC has complied with the rules, they can object and force FOS to apply a timebar.

    My point is that if the rules, as they stood at the time of the complaint were not complied with then you can.

    There is, though, a further development. The FSA has found that many complaints were wrongly rejected and is asking firms to review them. So you could go back to HSBC and say that, in view of this you want your complaint reconsidered - in effect a new complaint about the handling of the original one.

    Normally this would not be something that would be entertained but in view of the FSA's position, you might find it was.

    So are you all saying that my next stage is to go to the FOS and ask them to take on the complaint?.

    It looks to me like HSBC are not going to move on this, the most annoying thing is that I truly was led to believe I needed to take out the PPI to get the loan and at the time I was desperate. Money was very tight when I took out this loan and it was a last resort, I would not have take PPI and added to the loan if I thought I didn't need to and it had no relevance to a decision.
