I have been asked to help out with a family friend who purchased 26 internal doors from a builders merchant last November. After having paid for them to be hung it soon became apparent there was a major problem with some of the doors. 16 of them 'blew' within a couple of weeks. The manufacturer sent out a representative to look at them as did the general manager of the merchants. All agreed they were manufactured incorrectly and needed replacing. The sticking point is the cost of removing and re-hanging the doors. Is there anything anywhere that states that these perfectly reasonable costs should be covered by the retailer, or is he going to be out of pocket on this one? He has also said he would be happy for the merchants to arrange the job but 2 letters of complaint sent to them by recorded delivery have gone unanswered. Thanks for reading and any help offered.

Hmmm .... that is quite difficult - I would expect the retailer to pay for the doors to be re-hung .,... but am not sure ... have they contacted trading standards & asked them?

The short answer would be yes. The guys who hung the doors did not cause the damage, it was a manufacturing defect.
The Supply of Goods and Services Act 1982 S.11N (2) states:
(2)If the transferee requires the transferor to repair or replace the goods, the transferor must—
(a)repair or, as the case may be, replace the goods within a reasonable time but without causing significant inconvenience to the transferee;
(b)bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage).
So there you go, it's written in statute that the retailer have to pay the cost of re-hanging the doors.0 -
