Is this ethical?

I bought a computer program that has a faulty disc. Apparently this is a known issue. I coudln't install from disc, but i could copy data to HD and install from there.
The installation hasn't been 100% succesful; there are a few glitches - so far. meaning I may find more as i use it. I am using the software and it's perfectly fine otherwise - again assuming no further errors arise.

My question: is it fair to return the product because of these problems, even though I am using the software and it is, to all intents and purposes, otherwise perfectly usable. Should I settle for less than 100% when that is, to be fair to me, what I paid for - even though I can tolerate a bit less, and bearing in mind the potential for subsequent errors.

What are my rights thus? Thanks.

    That isn't what i said; i said it has problems currently. Problems I can tolerate, but problems nonetheless. It might also have more problems (which push it beyond the point of tolerance).

    If I have to reinstall at a later date (m,aybe when its way too late to return anyway), i still have a duff disc.

    Had the same problem a few years ago with Myst. Bought it from PC World and the disc was unreadable either on my computer or another, despite the packaging never having been opened previously.

    Took it back to PC World who said that my dispute was with the publishers of the program and they couldn't take it back as it had been opened (they pointed to a notice on the counter to that effect).

    I told them they were the retailer, my dispute was with them and the goods were not fit for purpose. They then reluctantly exchanged the goods for a new one off the shelf and said that if that didn't work, then it must be down to me.

    I took the disc but said that I did not accept their final comment. Luckily, the replacement worked.

    I would suggest you do the same as, clearly, the disc is not fit for purpose.

    Well said. That's exactly the situation (though not Myst). There's a note within the packaging that says some dvd drives may not read the disc (which surely must be tantamount to admitting to manufacturing faulty goods). Unfortunately this note is only available once i'd paid for it and the shop said nothing (they woudln't have known). But the dilmena comes from the fact that i have installed it and it is 99% working (again with potential for further errors). I want to proceed ethically in this and not rip people off, but on the other hand, as you say, it's a faulty disc and that's not what I paid for.
