You need independant legal advice.

As I said before, it is their responsibility to correctly operate PAYE and if they fail to do so they will be held responsible for the tax lost.
If your PAYE is wrong I allways thought the individual was still liable for their own tax but appears not

I would still want an idemnity from the employer just in case.0
