Imo the OP should consider taking the offer on the basis it will be quicker than a court claim and also keep the relationship friendly should there be other problems.
40 miles shows to me the clutch was toast when she bought it, id go for the jugular, but it could protracted0 -
Take the 1/2 cost offer as Inactive said. You will then have a car with a new clutch which you wouldn't expect to get on something that old.
Plan B, take the cash he's offered and get your mech friend to change it for a few beers.
Also consider if the dealer had said "look the clutch wonts last long, I can replace it at cost to you". You would probably have taken him up on it.
And how much hassle do you want over a quite old Nissan??

I would suggest either the OP didnt test drive it or is a crap driver. Either way I don't think they would come over well in trying to claim it must be the dealer who is stupid and lying.0 -
