Just how this would be applied to a 12 year old car I don't know, I think I'd accept the offer he's made, seems fair to me as you end up with a better car than you were expecting

I agree, take the dealers 50% offer, at least the OP ends up with a brand new clutch at minimal cost.

That really is matter of opinion. Satisfactory quality would be based on the age, price, condition, mileage etc. If the dealer could show the clutch wasnt faulty at sale then its really not close cut that its not satisfactory. We are talking a 12 year old car.

Imo the OP should consider taking the offer on the basis it will be quicker than a court claim and also keep the relationship friendly should there be other problems.

40 miles shows to me the clutch was toast when she bought it, id go for the jugular, but it could protracted

Take the 1/2 cost offer as Inactive said. You will then have a car with a new clutch which you wouldn't expect to get on something that old.

Plan B, take the cash he's offered and get your mech friend to change it for a few beers.

Also consider if the dealer had said "look the clutch wonts last long, I can replace it at cost to you". You would probably have taken him up on it.

And how much hassle do you want over a quite old Nissan??

    ;);)
I like the thanks button, but ,please, an I agree button.

Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

Always expect the unexpected:eek:and then you won't be dissapointed

    Not really

I would suggest either the OP didnt test drive it or is a crap driver. Either way I don't think they would come over well in trying to claim it must be the dealer who is stupid and lying.

As often happens, the OP has not returned to update, so we are probably all wasting our time anyway.:(
