    Made my phone call today and was advised that they have to credit the agreement first and that if there were no arrears (which there are none) I would get a refund, this is how they do things. After that any refund would be paid to me, I asked them to confirm this in writing, which they refused to do!

    I now have to decide whether to trust them and sign the agreement and see if I get any money back, or just go to the FOS.

    I'm thinking I will just sign the agreement, even if they don't refund any money, at least my monthly repayments will reduce and hopefully the time left to pay!

    What do you think?

    Hi there

    I know what you mean.

    You could still contact the FOS for advice on this before you sign, and if the bank did not do as they said they would you can still go to the FOS, realistically what they are going to do should be put into writing, so ring the FOS on this tomorrow and see what they suggest, at least your doing this in advance, good luck.;)
