Hello.
I have used the HMCS web site to claim back bank charges but the bank have made a defence and it is being heard in court. I have until 1st August to fill out a form and return it. Has anyone any experience of this? If so, any help/suggestions would be very welcome.
Many thanks.

Yes, virtually everyone who has done this has this happen. It's not a big deal. Just fill in the Allocation Questionnaire, send any extra money (if the claim is over 1500 quid), then sit back and wait.
The bank will most likely offer you 50% of what you are claiming. Refuse it and the next offer will be 100%.
Remember. The bank DOES NOT want to go to court. Even if they had a .5% chance of losing, it's still not worth the risk to them. In reality, they have a 99.5% chance of losing - I don't think they'll like those odds.
They are just taking it as far as they can (with considerable costs to the taxpayer I may add) to see how strong your resolve is.
Sit tight, stick it out and you will win, IMO.0 -
PS. Which bank is it?0

They will just make you think they will defend it mate to scare you.
It will cost them thousands to defend in court and if they did lose they would open the floodgates and get loads of bad publicity in the press. They don't want any of that, they WILL pay up!

Hi.
Thanks for the support. It's LloydsTSB. I will fill the form in and wait. Any more support/suggestions would be very encouraging - this has really spooked me.
Thanks.
