    Hi peeps - back now and had a fantastic holiday!

    :beer: I hope you all had amazing times and really, really enjoyed yourselves over the festivities ;o) :beer:

    Being away at Xmas and New Year was a totally new experience for me so I wholly recommend it to anyone who, like me, is a complete sunslave and needs to get away from the rain for a bit!

    We came back to:

    1) A letter from ARLA stating that as we are taking legal action against the letting agent, they cannot pursue the complaint. I promtly wrote back this morning via 1st class post saying that legal action ceased on 13th December, therefore please DO investigate, thanks very much.

    2) A 'miracale'! Amazingly (I hope you note the sarcasm) - the court case on 13th with letting agent seems to have miraculously generated a reaction by the Landlady herself. We believe the Letting Agent made fast & furious calls to her to warn her of how serious we are, seeing as 'criminal investigation' was mentioned in the court room and they must have soiled themselves... On the 15th (a mere 48 hours later) she logged her court papers and a date has been set for 17th Feb. She states on her papers that 'correspondence had been sent to wrong address' and also that 'amount owed by claimant is more than the deposit amount'. IE: she's making out she never knew about the court case (that was sent to her REAL address) and seems to be implying SHE will be pursuing US for the remaining £70 or whatever it was.

    Not 2 great things to come back to BUT, we are happy that she had to shift her butt from the rock she's been under and had to slither into court. She will now be aware that a CCJ is against her at least...

    Yeah - and the address she has put on the forms is the 'new' c/o address from said decorating cohort that we have discussed, so I'm guessing the court allows the defendant to have any address they choose, but the claimant has to have a 'servable' address.

    Given we tried writing to her 3 times at the old address, and were only told about her 'new' address in November, we could not have known that her REAL address was incorrect place to log the claim in the interim...

    Well I call that an excellent result! Obviously your court appearance kicked the agency into gear which is what you wanted from it. Now the landlady is recognising and responding to the court action you are much further forward.

    The question I have is which address turned out to the the right one for the landlady, or is it a new one to you? Only of it was one of the previous addresses then she should have known of the court action! Be sure to keep and present good records of what you sent where and when.

    17th February gives you loads to time to be well prepared. I would not let the 'criminal investigation' go either.
