Alliance&Leicester claiming back the charges from ME?????

Hi All,

Tell me this cant be please....

I received a a letter from A&L last week with regards to my account being overdrawn to the tune of £775.50.

My account has been closed since 2008 on A&L's request after I received the full charges totalling £775.50 back.

I contacted A&L customer service last friday and they said my account was now overdrawn. I questioned this as my account was closed therefore they should not be an overdrawn account as technically the account should not be opened unless we both agree..right??

Anyways the customer advisor told me its really irrelevant and that I owe this amount which is the charges I claimed from them in 2008, and that I need to pay it back in the next 6 months which works out as £130/month :eek: which is an amount I will struggle to pay.

I then asked, should the amount not be the agreed £12 which was deemed fair previously and she said no that the full amount belongs to A&L.

We agreed that I would get back in touch Monday(tomorrow) eeek

Has anyone else had similar letter's, please advise whats the best way to approach this.....

I cant believe they can request these charges back now... please help

  • If this is bank charges then there is no £12 limit.
    Can I clarify if you received a refund of the amount they say is owed?
    Did you get a cheque or was it paid into the account to clear any amount owed?

    I receive the monies by cheque as they had already requested and closed my account.

    Hence why I queried how they could now say that my account was overdrawn.

    Still though, can they acutally request the charges back?

    Unless you can show that the balance was at £0.00 at the point it was closed then I'm afraid the answer is yes they can. If the balance was at £775.50 at the point it was closed and they simply refunded by cheque rather than paying off the account then they can ask for it. I would be inclined to put in an income and expenditure form and state how much you can repay to them, something that is reasonable.
    £130.00 over 6 months is not reasonable if you cannot pay that amount.

  • I will have to verify this but to the best of my knowledge they issued a cheque(775.50) , then told me they were closing the account and to pay off what was overdrawn. I did this over a couple of months at which point the account was zero.

    I will have to go through to see if I have statement verifying this.

    In light of all this does this mean everyone who has reclaimed charges will soon be in a position to have to pay the banks back?

    No it doesn't but we are trying to see if the amount in question has been demanded from you in error or whether it is genuine. I suspect it might be an error.

    When they refunded your charges by cheque it would have been a gesture of goodwill,and no they cant claim it back.

    If however you used the cheque for other things than paying it into the account to zero the balance and clear it off then yes you will still owe the bank that 775.50.

    Not really sure why they sent you a cheque rather than just clearing the account, but you need to check with the bank if you repaid that overdraft,

    where did you pay the cheque into ? can you check with that bank what you did with the money ?

    If you paid back the bank the £775.50 you owed them, what are they demanding £775.50 for now?

    You need to clarify with the bank what they believe their basis of their claim is ... but the fact the amount being claimed is identical to the amount of the original o/d gives a good hint ;)

    All you probably need to do is provide that proof that you have already paid it back in full :)

    I think Premier is probably right.

    In less gleefull terms it looks like you are jiggered mate and owe them £775.50. Follow Nattys advice and see how much they will accept a month.

    Well firstly check if you paid it back from the cheque you received. If you did then they have nothing to claim off you. If you didnt then yes a repayment proposal is in order - but CHECK YOUR RECORDS first.
