Taking Control - but still need advice please??!!

Well after posting my previous thread where I didnt know where to start or what to do I finally told my DH that enough was enough and he couldnt bury his head any longer..I was TAKING CONTROL :j
I used the tools on the National Debtline(which is fab) and did a personal budget sheet to work out pro-rata payments to creditors, it wasnt as scary as I thought and we are in a bit of a mess but nothing that cant be sorted if we take action now, we owe £21300 on various cards and loans.I have used the letter templates on the National Debtline site and written to everyone we owe money to offering a pro-rata payment and requesting they freeze charges and interest(we shall see)
DH has instructions to ring the Halifax tomorrow(mortgage in his name so they wont speak to me) to sort out the 2 months arrears on the mortgage and ask what they can do to help, whether it be compounding the arrears or reducing our payments until he gets a job etc..I have told him he is NOT to offer any payment we cant afford no matter how proud he is.
I got him to cancel all DD's on his account and have written a hardship letter to First Direct requesting they refund all their extortionate bank charges and added interest using the calculator on MSE.

NOW...we still have a problem, he has a car on PCP agreement with BMW, when he got made redundant he rang them told them he could no longer afford it and could they take it back, they said no even though he was over half way through the agreement- payments are in arrears and yesterday we got a letter from their solicitors.BMW have refused the car back unless we hand it back PLUS £4,500 or they said he could try and sell it privately( as their dealer offered less than the final figure)-can he do this??? BUT..the PCP agreement when I looked at it yesterday has the wrong Car Registration number on it(we have never noticed this),also the dealer when we called them said the car was HPI clear, how can it be if it's on PCP??? can anyone offer any advice on this please or should I post it in another thread??

Everyone on this site is fantastic:Tand finally gave me the courage to sit down and open all those unopened letters and DEAL WITH IT I feel so much better now and DH is smiling again and feeling positive, I would urge anyone in the same boat to do the same, once you make that first step you feel empowered and the support from others here amazes me x x

    If not, I'd maybe start a new thread with the car bit in the title (if you haven't alreadt done so).

    Well done so far. You sound so much more in control and certainly seems like your DH is feeling better with a shove from yourself - keep shoving him :)

  • Hi Starting over, good for you taking control, I too did the same recently and have managed to renegotiate payments for six months with a couple of creditors which will help but will need to do this again when 6 months is up, soog luck with the car situation it might be worth checking with DVLA or get the police to check it for you, I hope this helps but it's worth a go.
