Loan Agreement - misspelled name

Hi All

Hubby has received the copy of the original loan agreement, but his middle name is spelt wrong.
He wants to reclaim the PPI, But I wondered if he may have a case for unenforceability??
Its with RBS
Thanks you

    Hi there

I am not sure on the unenforceability side of things, but there were a few errors in my name on one or 2 of mine that were just corrected, which I did not actually think it was an issue to be honest, but maybe someone on here will know more on this.

However, for whatever reasons you may have to reclaim on the PPI, check this link here below, its the guidelines of reclaiming, very useful with templates, a checklist of reasons and so on, they have 8 weeks in full to respond.

Good luck with this, ask for help anytime as well, and please let us know how you get on.

    Cheers.:)

No. A spelling mistake is not grounds for it being made unenforceable.

Remember, none of the recent test cases have found in favour of the consumer and if you went to court on a spelling error I would suspect that the judge would not be impressed with your attempts to get out of paying what you owe and would throw costs at you.
