Spa voucher from lastminute.com

I purchased 2 vouchers from lastminute.com for a spa day but they're taking too long to be delivered (ordered over a week ago) so asked for a refund as I then bought from the spa in question directly but they said they're non refundable and exempt from the distance selling act. Have I got a leg to stand on?

    A week is not a huge amount of time to not have received something by post, but a bit annoying. How was it sent? you could choose £5 guaranteed next day working delivery or first class (FREE) - take it you ordered the FC option.

    LM state in their T&Cs "Please note that delivery is by Royal Mail therefore lastminute.com cannot be held responsible for delays caused by the postal system" so they'll obviously just say 'not my fault'

    Why don't you wait and see if they turn up tomorrow or Tues. Am I right in thinking it was for a VDay gift? If so, could you just give your OH a card and let them know the situation? Will still be a nice gift when they receive it.

    If it's not turned up by a certain amount of time I'm sure someone on here will know the ins and outs of what you can and can't do - sorry to not be helful in this area.

    I believe a voucher that is then used to purchase services is subject to the DSR and you have the right to cancel before receipt.

    If they persist in refusing a refund, a quick call to Consumer Direct or Trading Standards should help.
