I did promise an update and here it is.

I am on the CCCS and this would be great to get rid of. What is my next best step? I know they are reluctant to stop payments to creditors.
I did wonder if it was worth sending them a stupid F&F for £500 to seal it forever. Is it worth a shot? They already have about £600 of it paid from my DMP.

Well done - its unenforceable so cease payments - like I told you last time we spoke! Its dead and buried now :T:T:T

You make no contact with them - you won!

Can I borrow this to show people on my thread? cheers mate.... #839

Yep, you have in writing, proof they cannot chase you for payments. I would cease payments and put it towards other debts.

Once all enforceable debts are paid you can then make payments to unenforceable ones if you so choose to do so.
If it was still with the OC and wasn't just charges and interest i would pay it, as its with the DCA the credit industry have already got there sale of it and basically written the rest off as a loss. I wouldn't pay lowell ;)
Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Mate steady yourself - rewind and walk back out and in again! Drunk? lol

You do not ever pay an unenforceable debt! Never - why would you? Just send the cash to me if you wanna throw it away! Tsk, mate I thought you knew better :naughty::naughty:

I'm just looking at that image in post #11. I am green with envy :p

I've just started down the unenforceable route with one creditor and have two more likely creditors that may be unenforceable plus a couple of 'chance my arm' ones. If I were to get a letter back like that, I'd be dancing around the room.

I pay my debts, not that I have any. But I won't pay a debt I disagree with.
Sure, its not a financially good thing to do, but it is the moral way to deal with it.
They are unenforceable, not written off :-)

    ^^

I had all intentions of paying off my debts too. I was/am making payments of what I can afford. Some of the credit card companies are making my life hell though, so I want them to pay.

The ones that are letting me get on with it, I'm paying.

I cannot stress enough how important it is to protect that letter, in fact, you should protect it like you would a child ;) one day you're going to need it, no now, not tomorrow, not next week or next month, but maybe in 10 years, yes 10 years time, someone's going to be asking for payment  the scum of the DCAs buy old debts, having that letter will send them packing!!! :rotfl:

Thanks guys. N-I-D of course you can use it in your threads.

My only concern is there anyway to prevent them from selling it on and I start from the beginning again.

The letter of course will be looked after.

This is where my 'newness' to all this rears its head.

In 10 years time, would the debt not be statute barred anyhow so you can just get rid of anybody chasing the debt that way?

But I do agree, I'd be keeping that letter under my pillow.

It will be SB in 6 years time, however, just because a DCA holds a credit licence doesn't mean they understand consumer legislation

99.9% of the time, it's down to the consumer to educate them :rotfl: and even then, some won't accept what's quoted

The letter saves getting into a paper exercise with any of the muppets :p
