Temp workers normally have a notice period of 1 week, and you are sub-contracted out by your agency, which is another contract you must adhere too.
I think it's normal for anyone to expect at least 1 weeks notice for a job. And maybe your current boss is probably over reacting with regards to her threats, but I would expect them to be a little naffed off tbh.
Temp workers can be taken off a job with no notice - just "stop working now" is possible. The mutuality of the situation is that the temp can also decide not to go in - and be paid for the work they have already done.
Even for employees the statutory minimum notice is one week (after a month's work).
It might be "normal . . . to expect one week's notice|" but that is not the law.0 -

Hiya thanks for the reply, I'm not leaving yet and I havent given notice to leave all I am saying is if I go ahead with my training on monday, tuesday half day and wednesday whats the worst that can happen to me, Its trainig for a job i have been offered by the nhs and i have to do the training or i will lose the post, and i dont want that to happen,
I need to sort something before tommorow, i want to go tomorrow but dont want to cause trouble, but at the same time im thinkin g about me and my kids here and for a better future.

Liney is correct, you are well within your rights to refuse to work. You make yourself available for 4 days and not 5, if they don't like it they will offer you nothing.
You are not an employee of the company, you are effectively either self employed or an employee of the agency, depending on what type of contact you have (either contract for services or contract of services). Yours (by the 0 hours part) sounds like a contract for services and so you are efectively self employed.
The agency decides if you have work or not, the agency pays your wages etc.
As for suing you for losses - poffle. The agency already knows you will not be available on Monday and so should have taken steps to get a replacement sorted, not your problem! The only losses will be the Agency Margin if they don't send somebody else, this will range from 35p per hour to about £1.50. No where near enough for you to be worrying.

I agree with ableandy, BUT if you have any contact numbers for phoning in sick, use them NOW to 'remind' the agency and the workplace that you will not be available Monday, half of Tuesday or Wednesday. That way the agency has a chance to redeem itself with the workplace by finding a replacement, and (presumably) vulnerable people aren't left uncared for.Signature removed for peace of mind0

your contract is with the agency, so you do what you need to do.
You are paid directly by the agency. The company pays your agency a fee. They company doesnt lose anything if you dont work there.
And also, tbh, I would have thought that to chase you for so called loss of earnings (who is losing earnings here?!) would cost someone more money than they would get back, so its really not in their interest.

Have you actually said you'd go on the NHS training days? Did you let the agency know the minute you were aware you were to be training on Monday? What have you said about your agency job on Monday, have you know backed down?
The worst that can happen is you will lose your agency job entirely, you *should* be able to claim benefits but that depends if the agency gets difficult. have you had official confirmation of the nhs job offer in writing? have you had your OccHealth and CRB checks completed if required? have you had a start date?
if not, then you may want to wait for these before you start the training and keep on with the agency until then?0 -
I would take the risk too.
I've been let go from an agency job with a day's notice before now even though I had a contract that said they had to give me a week. It works both ways. Like people have advised, have a quick check through your T's and C's and maybe just take the risk anyway? I know I would, I'm in a miserable temp job myself and wouldn't think twice about leaving without giving proper notice here!0 -

yea i took the risk i didnt tell the agncy or the place where im placed i was going on monday cos they would of said no again, its my dream job and no one is standing in the way of it, im a single mam bringing up my kids alone more or less, and took the risk and got for my training,
the agency rang me told me to see them on the monday (15/02/10)
which i did i knew i was gonna get a bollocking, after the boss at the place whre i worked kicked up a fuss saying she needed me cos so many staff were off sick she told the agency monday she didnt want me back at the centre, this is fine with me as i hated working there with the other staff, not the agency has told me not to gop there again and that they will be writing to me as i am facing a disaplinary action now which invoolves they said 1- a written warning 2- a verbal and 3 dismissal, because i went against my employer. i made a decisiion to better my self and my kids lives, the boss didnt give me a weeks notice she just finished me for not going in.
i ama awaiting to hear from the agency now.
so dont know whats happening.
