1 weeks notice.

Hi Everyone,
just want some advice here,
I have been offered a Job working in the NHS as a healthcare assistant, I was due to start my 2 and a half day training on monday,
I work for an agency at the minute, so I rang them and told them and they were ok with me going on monday, however When they told the boss of the place where I am working at the minute, she kicked off saying I was in breach of my contract if I didnt turn up for work on monday morning, as half her staff are off due to the kids being off school next week.
I am so angry I have the oppertuinty of a lifetime here and will not be able to do it, I cant see whats wrong as Im not leaving yet, and I havemt given notice as I dont know how long after the training I will be starting work with the NHS.
i rang the agency yesterday and they said that could sue me for loss of earnings if i didnt turn up on monday for work, id only be missing 2 and a half days, thats it.
can anyone shed any light on this,
what would be the worse case sanerio if i went ahead for the training course.

    What does your contract actually say about notice?

  • I have never heard anyone being sued for loss of earnings.
    If you did not turn up, you might get a bad reference adn could be dismissed for being absent without permission, but as you are going anyway...
    How would she cope if you were off sick?
    If she is so short staffed, why has she agreed to so many people being absent?

    im subconttracted to the place im working in !!!!!!

    They could only sue for financial loss fort actual costs to get someone to replace you which lets face it wont be much and the likely hood of them doing it are slim.

    If its your dream job take the risk!

    On another point what type of contract are you on with the agency? If its zero contracted hours then you are not obligated to accept the work they offer.

    The reason lots of firms take on agency staff is there's little protection they have compared with salaried staff, when business goes down they can get rid at the drop of a hat. Some workers though prefer to work for an agency, they can more or less come and go as they please, choosing whether to accept contracts or not, mothers for example with young kids.
    Don't think anything can be done to stop you leaving when you want, only thing they can do is say you can't get paid until whatever your next pay day would have been.

    Hiya thanks for the reply hun
    i dont know but the agency said they would sue for loss of earnings if i dont turn up,
    the boss boss of where i work is a crap manager anyway she has favorites and they always get their holidays first and us agency have to work around they permanant staff which i think is wrong and have said so,
    its just the way that centre works, i have already got my references in hence me being offered the post in the nhs,
    im so angry im one of the only staff there that dont take the pee out of her and have days and days off, but she wont even listen to me,
    shes always short staffed but its not my problem im just afraid of what will happen to me if i do go as the shifts with the agency are scarce now,
    not sure what to do for the best xx

    If you mean zero hours contract then you can just stop working subject to any conditions on work you have allready aggreed to do.

    Zero hours works both ways.

    They can offer you nothing
    You can reject any offer of work.

    Your contract is with the agency.

    thanks for reply, thats what i was worried about as i dont know how soon after the training i would see my next pay day,
    i work 30 hours a week at the centre now, im always there never take time off or anything but was still refused these 2 and half days for traning.

    Is your contract with the agency or where you are working?I would have assumed the agency have the contract to supply the company with staff ( if one exists , Ive never come across anything like this when we have employed agency staff )
