How do I find who owns the service road ?

I would appreciate any advice you can give me. We live in a block of 14 flats that are all leasehold. All of the flats are over shops and at the back of the flats there is a balcony with stairs running down to a service road, where the dustbins are situated and any deliveries that come for flats are delivered. There is no parking for residents in this area and on our leases this is shown as a service road. One of the shops has cordoned off part of the service road at the rear of his shops, he is at present having some buiding work done on his shops. He is now stating that the service road belongs to him and making access very difficult. The Agents that manage the flats are useless and don't seem to know who the road belongs to. My question is, How can we find out who the land actually belongs to, can we find out from the Council or do we have to go to the Land Registry. Would we have to pay for the information from the Land Registry? I would be grateful for any help. Thankyou.

    Google the Highway register for your area. It usually comes up through the council page.

  • If your Land Registry plan also shows the service road, photocopy it, put a red line round the area of service road you want to find out about and send plan with a completed SIM search form (downloadable from LandRegistry.gov.uk) to the Land Registry.

    This will come back in a few days and should tell you the title number (assuming the land is registered).

    You then use a OC1 form to apply for a copy of the title and that will tell you the owner.
