    I'm not being specific to this post I find the attitude of some posters throughout this particular board very rude and just can't see the point in them even posting if only to flame the OP.

    Yes of course I'd like to sell the phones and I feel I made that quite clear in my original post

    The point is that I don't want to do anything illegal/be a thief. So I came on here for advice. I thank the genuine people for there advice and will indeed be writing to the company in due course.

    So yes I'd like to profit at the expense of a multi-billion pound PLC i'm sure they'll miss £300. (if that's even what they pay for the phones.)

    Legally, I'm quite sure they're not yours, and you should write to them to let them know of their error, and give them a reasonable time frame to collect them at YOUR convenience.

    As you did order a phone, and it was a computer error, then I'm quite sure they can ask for them back. If you'd already sold them, then I think they're then allowed to bill you for them.

    If money is tight, why are you ordering a mobile phone upgrade?!?!?! If you want £150, sell your own new handset, and carry on using your old one ;)

    Found the following

    "Goods sent to a person who has not requested them. The person receiving the goods does not have to pay for them. After 6 months the goods become the property of the person who received them. If the receiving party contacts the sender and asks for the goods to be picked up (and they are not), the receiving party becomes the owner of the goods after 30 days. Before the receiving party becomes the owner they must look after the goods and not dispose of them".

    This is not relevant. As DaisyFlower has stated, these are not unsolicited goods, they are an error.

    OP, why not apply some common sense? If you do not want to do anything illegal, why not just call the retailer? I am sure they will answer your question. ;)

    In other words you (like many of the folks on here) are going to ignore any advice you get unless it is what you want to hear.

    Basically you've matched almost everything that is needed for theft - there is deception (by not telling the company) and conversion (selling the goods). Basically the best you could hope for is to be charged the cost of the phones if you sell them.

    Grow up and contact the company, there's no such thing as a free lunch.
