Is my dad entitled to Redundancy Pay???

My dad is 63 and has suffered from a heart attack in 2005, an angina attack, has a metal knee, has sciatica, a peptic ulcer and arthritus. He worksfull time as a landscape gardener where he has worked for 23years. He is finding it very hard to work with his health but cannot financially survive without his oney from work.
Is he entitled to redundancy pay?

    Unless they make him redundant then no, if he is incapable of doing the job then the company could let him go on capability grounds but they have to go through a process to do this.

    Medical retirement maybe a possibility BUT i don't know anything about this but hopefully someone else will

    His bet bet would be to ask about early retirement on medical grounds otherwise he is going to have to hold out until he is 65.

    Could he reduce his hours? May be he can get benefits to top up his salary?

    He needs to talk to his HR people to see if there is a possibility to retire on the grounds of incapacity.

    But no, he would not be entitled to any redundancy money.

  • The reason he would not appear to be entitled to redundancy is that redundancy in employment is about the job, not about the person.

    So, unless they were keeping him on "to be a compassionate employer" when there really wasn't a job and they would not replace him if he left, the job is not redundant.
