Employer not paying on time - can employer pay bank charges?

I resigned from my job last month and I was expecting to be paid on the 1st of this month, they have not paid myself or my former colleagues (who still work there) and they say the money 'will be in tomorrow', tomorrow still has not come and it has now been a fortnight. I have received three bank charges as a result of not being paid, my question is "is the comany liable to pay my bank charges?".

    i would believe that they are not liable as it is down to you to make sure you have enough funds in your account to cover any costs and not for you to rely on your wages. this is why any direct debits or other debits from my account i try to make away from my pay day.
    However you may find that they will pay as a couple of months ago my emplyer m&s paid all staff 1 day late and as it was due to their mistake they were going to pay dany bank charges incurred

    i'd say employer should pay them

    but as an ex employee i don't know if things would be the same

    2 weeks late for some people - is there a union?

    My salary cheque bounced one month. My employer met all of my consequential expenses.

    At my workplace, if there was an error in your pay they will pay any fees that this has caused. Some times they will use "petty cash" from a till if you really need the money ASAP.

    You said their current empoyees hadn't been paid on 1st July either. Presumably they have been paid now. I think you need to pay them a visit. Have you been chasing them since? If not, could it be an oversight on their part? Is it a big company? Did you leave on good terms?

    Employers have a moral obligation to pay bank charges, but not a legal one. Since they appear to be ex-employers, I don't think you'll have much luck...

    It will really depend on the size and cashflow of the company. Many large employers will pick up bank charges in this sort of situation and have the resources to do so. A small company, who didn't pay due to not having the funds themselves, may not do so - or even be able to do so if cashflow is an issue for them.

    Of course, you have a right to insist on being paid for the work you've done, but I'm not sure if there is a timescale attahced to this, either legally or morally. In the meantime, you need to pay your bills, and they are within their rights to chase you for any late payments - irrespective of the circumstances, you owe money just as you are owed money.

    Tough one though :(
