Can I up a payment to only 1 creditor?

Just a wee quick question - can i up a payment to only one creditor? I have received court papers for one of them and they have said they would accept an increased payment of £50.

So my dilema is do i go to court or up the payment? I dont know if CCCS will allow this but i really do not like the idea of going to court. I would rather struggle a bit more and find the extra £50.

So if i can do this, will CCCS allow me to do this? And does this mean court proceedings will stop?

    Hi there, CCCS won't allow you to do this and will ask you to self administer if you want to go ahead.

    I'd call CCCS, let them know what's happened and forward any letters you've been sent and let CCCS deal with it.

    If it did get as far as court, it is likely that a court would be in your favout as you are on a DMP through CCCS.

  • Agreed to the above, you need to make fair payments to your creditors, if other catch wind you are favouring someone else, all hell can break loose as they will all want a bigger slice, although there isnt any to give they will go for more CCJs.

    Just let CCCS know, as well as the court that they are already getting the maximum possible, Judges do take note that you are already paying the most you can afford and this is all a CCJ would grant anyway. The Judge may look to the creditor as wasting the courts time and dismiss the case.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    saw this other post from u! i think you would be able to increase your payment if u really want to. i know the cccs are great but at the end of the day - it's your money and your debt and if u want to increase a payment they cannot stop u - they can advise u not to but they can't stop u. i'm not with any organisation for my DMP - i deal with them all direct, but the other creditors always ask when doing reviews - what your balances are and how much your monthly payments are with all your creditors - they then work out what they think they should be getting in relation to this.the cccs have obviously done this to ensure all your creditors get a fair slice of the cake. thats the only obstacle u have to increasing the payments - other credititors. as i said in the other thread, the way i deal with this is by telling the other creditors that the reason i am paying so much to RBS is because it's through the courts and i have to - they can't argue with that! xx

    Please do not create 'preferential creditors', it will get you in no end of trouble. Set a fair tarriff for all through the CCCS or through the courts and then stick to it. If you want to increase it go back to either of these and get them to sort it for you.

    It might be a hassle but let the system protect you and your creditors.

    I think i'm just gonna have to go to court. The last thing I want is to go there but i also do not like the idea that they could all end up taking me there!!!

    Will this nightmare ever be over?

    I gonna speak to CCCS in the morning and i will keep you all posted.

  • yea - i agree - go to court - the sheriff will judge it fairly and if the court ask u to pay more it will be through them and the other creditors cannot do anything about this - as i said, the only thing we wanted to prevent was our house being taken and our wages arrested - court's scary but i was glad i went and held my head up high

  • I dont agree with much of the above

    1 - I have been battling with CCCS to increase payment to 1 of my creditors , and have lost, If you want to pay more you need to run your own DMP (I am about to start)

    2 - CCCS dont apportion payments as fairly as you may imagine. As they have explained to me firstly they look at contractural payments not balances, hence if you owe Creditor A £2K and they have a contracural repayment of £200 a month and creditor B £4K and they have £100 a month, creditor a will get twice as much as B from CCCs even though they are owed less

    AND, to confuse things further CCCS derive contactuiral p[ayments for credit cards at 3% of balance, which is often less than the minimum, even CCs are normally the highest interest rearing debt, therrfore meaning overall, assuming you are not lucky enough to get interest frozen, you pay less to the biggest interest creditors...

    sorry if I didnt explain too well

    that's interesting to know - i don't have experience with cccs as i do my own DMP as well but it sounds like a strange system.

  • god - no! i didn't mean that at all! i think their system sounds a bit mental if that's what they do! i actually went with one of the commercial DMP companies a few years ago (crazy I know!) and I now just deal with all the creditors direct - it's actually not that bad - i get a bit riled up when i'm on the phone to them but they deal with you direct just the same as they deal with an organisation doing it on your behalf. it's not actually any harder doing it yourself - you still have to deal with all the figures, balances, incomings, outgoings etc that you have to with cccs. all of our credit cards (3 in total) have been sold on to an external collector and they're actually alright at taking what you can afford to give them - as has our abbey loan for £8000. i don't think you're hijacking the post at all - i think el skinto will be glad to hear from all experiences xxx :)

  • Thanks guys and you are deffinately not hijacking the post!! As Olivia84 said i am really glad to hear all experiences.

    Just spoken to CCCS and they are now advising me to try and change this over to a DAS. So have to go and see a money adviser again with the view to get this changed over.

    Really hope this can be done as i dont want to go to court and just want it sorted.

    CCCS just said that if we up the payment then it would be a snowball effect and the other creditors would also do the same thing.

    The DAS is my last hope and if that doesn't work then I don't know what we will do.
