I must say one thing natweststaffmember - I don't see why you want to leave Financial Services....people like you are needed when dealing with people like me...Disclaimer - Info about the law is designed to help users safely cope with their own legal needs. I don't but would you hire someone who would leak confidential information to a third party without the companies knowledge, information that would later appear in a newspaper/BBC website? I wouldn't and I wouldn't hire myself, so I haven't worked in financial services since February 11th 2009 when my employment was terminated.
I work for another very well known institution that has celebrated its 800th anniversary last year(that is a clue btw).
Hicskis, I think you know I am very passionate about what I do and I can sometimes come across as a little harsh(which I think I was either on this thread or the other one). Hopefully, you take it in the spirit or the passion that I have for the bank charges campaign rather than in any personal way. I'm still interested in this if the argument is one that can be made and adds to what we already have but we have to be cast iron because otherwise people will blindly follow advice and not know what they are arguing.0 -
Good so we know we are both working for the same team - albeit not being paid!
Does anyone out there know of any Case Law that might be of benefit here?
We are looking for cases brought in the courts by people who have challenged the data reported to the CRAs in their credit files...along the lines of irresponsible lending....Disclaimer - Info about the law is designed to help users safely cope with their own legal needs. natweststaffmember - do you know anyone in the legal department there or any students studying Law that might be able to dig for some Case Law? There was a guy who sue'd a lender for inaccurate data on credit files and got a payout because he could prove he had lost that level of investmnet because of it. Something about buying a house - section 13 DPA compensation etc... am looking it up for you.

also http://www.thisismoney.co.uk/news/article.html?in_article_id=451688&in_page_id=2
Both cases are other way around - ie. claim for damages for things being reported that werent true and stopped further credit being obtained.
You really want case law where things havent been reported and irresponsible lending has arisen. I dont know of any.LegalBeagles0 -
Thanks esmerellda - makes for interesting reading - do you know of any English Case Law. The case you sent me could be used except for the fact it's Scottish....

So esmerellda - i'm back. I've just scribbled some ideas down on the back of an envelope. That case you gave me could work - can you find me one in the English courts though or two would be better still?

There was a guy in huddersfield (I think) taking O2 to court for incorrect data reporting - he was suing for 100k and got default judgment, think O2 applied to set aside but no idea what happened after that. (oh I linked to that story already lol)
You really want the opposite argument - aka irresponsible lending - which includes CRA data issues .... most claims will be dPa sec 10/13/14 where inaccurate data has less to loss of chance but there will be something somewhere, keep looking
FSB is being read in the Lords 23rd Feb .... Lord Whitty would be the guy to talk to once you have a planLegalBeagles0 -
