DAS or IVA?

I am currently on a DMP through CCCS - this was started in August 2009 adn up until now things have been ok. Came home from work tonight and received court papers!! ARGH!!! I am really stressing about this now!!

Originally we saw a money adviser who said we could manage to struggle!!! i knew we couldn't this is the reason we contaced them in the first place. Anyway the guy wouldn't do one for us so we telephoned CCCS and started a DMP and it was like a weight was lifted from us.

The court thing is really worrying me - i no that a DAS they can't do this but so can i change this over or is it too late?

Also not too sure about IVA, is this maybe the best way forward? We are managing to pay £330 a month to the DMP for debt of £23000 for 5 years 6 months.

I just wish it would all finish. We really want to sort this out - we had a failed business and this is were it all started!! Just want this all paid!!

Any advice would be really appreciated.

I know that you must be really stressed right now, so I'm sorry to be asking more questions.

Can you let us know if you're in England or Scotland first of all? The thing is that you mention DAS (which is purely Scottish law) and you mention an IVA (which exists in English law, but not Scottish law - although there is a Scottish equivalent).

Next, can you let us know a bit more about the court papers. Are they to do with a CCJ, or a Charge for Payment, or is it a petition for bankruptcy, or something else?

Once we know the answers to those questions, it'll be a bit easier for people to give you advice.
