PPI claim trouble

I have tried to claim my PPI back from Bank Of Scotland and just recieved a letter from BOS together with a photocopy of of my Application form when applying for my credit card. The card i applied for was through Unison and was a postal application that was completed without any advice.

I to only spoke to Bank Of Scotland at the time when calling them on the phone regarding the insurance and asking about it as i wasn't sure. i remember being told it was assist my credit application.

They have told me that because it was a postal application none of the reasons i stated are valid in my claiming back insurance.

Please help!

    If you send a SAR letter asking for all info they hold on file about yourself you may get a copy of that telephone conversation. This will obviously back your claim up then. If you send a SAR you have to give them 40 days to reply and send the information. Have you done this already?

    Hi, before you spoke to someone at BOS did you send the completed form back or after? If you spoke to them first and then completed the form then as maxdp says, a SAR may prove this but if you sent the form in before and ticked the box for insurance then this may be difficult. Also what was the conversation that you had about the insurance?
  • I just asked if it was to cover me if i was ill from work and redundancy.

    I applied for and recieved the card in 2001. Will they have phone records from then?

    Maybe not on cd or tape but some have transcripts of conversations going back that far. I know my bank did.
  • So if there is no record of my phone call, does that mean i don't have a case??

    No, you always have a complaint if you know you are missold or feel you have been. If they send a final response and it is that they do not uphold the complaint then you would be free to ask the FOS if they will look into it for you.
  • I'm sorry for going over old ground, but it's really eating away at me!

    I'm ringing the Bank of Scotland tommorow to tell them about the phone call asking for advice before i filled in the application in 2001. What happens then if they say they have no record of the phone call??
