Faulty Mobile, Orange warrantee legal?

In July last year I got a new Nokia 6700 which I ordered over the phone direct from Orange as an upgrade/new contract.
A couple of months after I noticed it had turned itself off once or twice.
Upon phoning Orange, I was told that sometimes mobiles can do this when they are in your pocket as the battery can be loose.
I mentioned that this was not acceptable as a phone in your pocket was normal use. I agreed to try it a bit longer to see how it went.

Since then the problem pops up now and again, even when it is sat in a static postion, on a table for example.
It has also frozen a few times meaning I had to switch it off and back on again. It has even turned itself off mid conversation.

I phoned Orange and they seem to think that I only have a six month warrantee with them and after that I have to contact Nokia.

Is it not the case that I have a Contract of sale with Orange and that, under the Sale Of Goods Act, I am covered for it for at least 1 year with Orange (isn't it 2 in EU?)?

I haven't yet phoned Nokia but I'm sure they'll ask me to send the phone to them without me getting a replacement.

I should also mention that, I have seen on the web that other people have experienced these phone problems suggesting it's a known fault with the phone.

  • I think Orange's policy consists of this:

    but they do (or should do) accept returns on faulty goods - Within 1 month, return to store for refund, Within 6 months, return to store for repair, and After 6 months, contact manufacturer. To be honest, you could argue with Orange that it is their responsibility in the eyes of the law, but I think going direct to Nokia may proove more effective - if they know about the fault, they should repair it without argument, so I suggest giving them a call.

    Nokia will require you to send it for repair and you are right that you will not be given a loan handset.

    Your other option is to take it to P4U or CPW and book the phone in for repair, they should be able to offer a loan handset whilst the handset is away for repair (you will probably need to pay a deposit for the loan unit as you didn't buy the handset from them).

    For future reference all Nokia handsets have a 2 year manufacturers warranty.

    Good point, I missed that bit from the OP.

    To OP, if you need a loan-handset, consider getting a cheap one from somewhere like eBay. Pop your SIM card in it, and it should be OK for the few weeks your phone is in for repair.

  • I had this model and also similar Nokia models in the past, they all suffered similar problems particularly the freezing, so no longer use Nokia's. I found that upgrading the software to latest version via their website helped also deleting old texts etc keeping memory usage low.
