car or home insurance cover this?

Very briefly my father in law, was convicted of abh ( actual bodily harm) and possession of an offensive weapon at LEWES Crown Court in Jan 2006. Without going into loads of detail it was a dispute with a work colleague that got out of hand and her partner drove a motor bike at my father in law resulting in my f in law fighting with the husband and wife and also the sister. Crown court dismissed assault charges on husband and sister but guilty on work colleague, made to pay £1000 compensation. Now they( husband and wife) are pursuing a personal injury claim against him, can my father in law make a counter allegation for the following reasons, he was assaulted , ( common assault, possibly abh (shock) SUSSEX police in there wisdom never brought any charges against other parties. Lost his job , hasn't worked since, suffering depression for which on medication. Would this be done via his car insurance or home as the incident took place just outside his workplace as he was going to his car.

    I presume he means legal expenses cover and it would be his home cover, not car.
