    No. Clamping to recover an alleged debt without a court order is illegal.

    I'm sure it hasn't stopped some though, and when it does happen no doubt the police take little interest and your only method of recourse is an angle grinder.

    NO - you certainly will not, NCP don't do this and it's illegal anyway! You can't (legally) just be clamped where there are no clamping warning signs and you can't (legally) just be clamped to try to force you to pay an amount you owe (let alone an amount you DON'T owe...).

    The parking drones don't have your numberplate marked down in some little book as a non-payer and even if they did, the only thing NCP could legally do would be to try to make a Small Claim - which they won't, because like the vast majority of PPCs, NCP don't take people to Court. They get their money by intimidation and scare tactics - but it's not scary if you know what to expect and that you haven't committed any offence!

    I don't see how NCP are 'harsher' than any other scam private parking company though, they are all much of a muchness. It's just a series of letters and you've seen a clear example of them thanks to Alx*27 - so the letters are hardly going to scare you when they arrive, surely? It's just like the pieces in a jigsaw, once you have them all the 'game' is over...they'll stop.

    I got a Euro Car Parks ticket last year, because a relative parked my car in Sainsburys' car park for a few minutes too long (so what?). Of course I still park my car at Sainsburys - the PPC gave up sending me love-letters ages ago.

    You are safe to park in the same place as much as you need to. In fact, some people go back again and again - deliberately setting out to get more scam PCNs for fun, just to cost PPCs some money! I don't do this but some on pepipoo.com have had hundreds of these fake fines and ignored all of them.

    Just to be clear, IMHO:

    - Anyone who pays a private parking ticket is a mug (harsh but true).

    - Anyone who pays a private parking ticket is lining the pockets of rich parasites.

    - Anyone who pays a private parking ticket is supporting/funding the scam.

    Now just enjoy life and smile when you get another letter - I did! I showed all my friends as each one arrived from Euro, as I wanted to show them what happened. Please tell your friends & family about this scam as well.

    I've got a plastic clip at the side of my volvo windscreen just for holding parking tickets. Pity they don't put them on all cars.

    A Volvo eh ptp - it's not an S80, 12 months old by any chance is it? ;)
  • Err no, its a D prefix 740 with 195k on the clock. Not environmentally sound but its good for deliveries and towing a big trailer.

    If you cause damage to the clamp, whether or not it should've been there is irrelevant, you are going to be paying them for definite.

    I always get my mate out to remove them as he's a locksmith and that is perfectly legal to do as you aren't damaging it in any way. And if he wasn't around, I'd rather pay more to a lockie to do it, than pay to scumbag clampers!

    Is it true that NCP use the councils traffic wardens and if they do what implications will this have on the fine? When i get home i'll scan in the ticket for the pro's to take a look as i'm sure it something about a railway act blah blah need to check. :cool:

    Don't cut the clamp, cut the lock. Anyway they would have to prove it was you who cut it. Wasnt me guv, it was this bloke!

    I carry an angle grinder and would not hesitate to use it.

    NCP don't 'use' Council traffic wardens.

    But NCP do sometimes hold the contract to issue REAL tickets on behalf of Councils and Railways. These would look different and should clearly carry the Council or Rail logo as well as NCP's own details.

    If your ticket mentions Railway Byelaws then it's worth a second look, maybe register and post about it on pepipoo.com and post an image (front and back but without ID details). They are the experts and can tell you if there's a chance it's a real one.

    Check who the PCN says to appeal to? Basically, I think if it states you have to appeal to NCP then it's a private ticket, if it says appeals to the Magistrates Court then it's a real fine.
