Help! Sellers want to push back moving date

Hello

I was due to move into my new house on Friday 12th, and after problems with my bank paying the deposit to my solicitors (they didnt make the chaps payment twice) and pressure from the sellers to get this sorted and paid as quickly as possible, I got a message from my solicitors saying the sellers wanted to hold off moving for another week.

I've already arranged for a moving van and I'm having furniture delivered on the Tuesday. I dont know what to do. Do I have any rights at all with this?

  • Have you now Exchanged?

If so, was a date for completion mentioned?

    I suspect you haven't.

What's probably happened is that the sellers waited and waited for exchange to make arrangements, but now with only two days left they cannot book removals etc, in time.

As opposed to you, making assumptions everything would go ahead, booking vans/furniture etc, who is ready without a contract to fall back on.

This is an example of why its a good idea to have a longer time between exchange and completion, so you are not tempted to jump the gun.

Is it so problematic to re-book the van and furniture delivery? Get the furniture delivered to somewhere else (family?) and use the re-booked van to move it on the new moving day?

You will have to negotiate with the sellers, to come up with a workable compromise.
  • No, was due to exchange today.

I dont think its down to the moving cause when I went round last week to take messurements, the house was empty. Even the carpets had been taken.

    Guess I have to rearrange

If it's empty then find out why they want to change the date.

Oh, how many times have I tried to explain all this to people and they still jump the gun....

We are currently selling our house and buying another, but have had to push our original completion date back by a couple of weeks due to our builder not arranging a gas supply in time!! We have asked our solicitor to ask our buyers solicitor whether they are ok to push back a couple of weeks, but have said that if not we will move out as planned.

Your solicitor is the best person to advise. If you really want to go ahead as planned then you could get pretty firm saying you'll pull out. Up to you really.

I know it's jumping the gun when you book things in early, but sometimes you simply have to. Removal firms go through this day in day out as do people who fit carpets and deliver furniture. If all service providers didn't deal with you unless you'd exchanged contracts they'd go out of business pretty quickly! They will deal with you and it's all part of the process - it's really only you who's being messed around by the delay, the firms involved are used to it.
