Sarah - the insurers that both my father and I were covered with was Millstream at Lloyds - A point that may be relevant though, in both cases Millstream settled our claims and then went after the other parties. (carefull not to say guilty as I do not know any outcome)
In my accident's case it was Granada TV and they were self insured and refused to settle. In any case I was gratefull to Millstream.
So in our cases ity could well have been an uninsured or underinsured cover.
Health & Safety laws (I think you mean te Health and Safety at Work Act) in that case the Farmer (under this law) is responsible for his employees only.
A common misconception. As part of a Risk Assessment, you have to consider who might be harmed and how - including members of the public.
To quote directly from the Health and Safety at work:
It shall be the duty of every employer to conduct his undertaking in such a way as to ensure, so far as is reasonably practicable, that persons not in his employment who may be affected thereby are not thereby exposed to risks to their health or safety.
