hi i posted a earlier thread about a friends situation re house and separation..
now need some more info from you great people for her as i cant seem to make head nor tail of the benefit system and dont want to give her wrong info,,
Her and her partner of 10 yrs have split, she has a 14 yr old from a previous marriage and gets £115 per month for him.
The morgage her partner is paying as house in his name
she also gets £80 per month child benefit
£20 child tax per month.
she has a temp part time job at M&S but this has dropped now to 3 hours per week, ( didnt want to give it up incase they could make her permanent)
she has been told by the jobcentre and benefit people she is not entittled to income support but jsa but probably wont get any money from them as her income from the above will outdo what she is entittled to but that she has to show willing that she looking for a job to get council tax help etc.
She has been looking at options re the house , one option was selling to one of those companys that buy your house (he in agreement with this)
another option as she not on the morgage is that he can rent her the house ( not the full morgage value though as this be to much for them to help with ) as this means he can also get a small flat to live therefore not to much upheaval for the child involved as he considers the child to be still part of his family.
can anyone help me advise her on the best course of action and what if anything she can claim whilst looking for a job, has been looking for a while before the split. and to weather she can rent the house/home from him or he move back in and she moves out and rents something private.

No she cant get income support as her child is too old, she is seen to be able to look for full time employment. She could possibly get JSA depending on the amount of NI she has paid. Can she not look for a full time job?
I really dont think she can rent the house she has been living in with her partner and he still has the mortgage.
I take it they have no children together? He can easily live in the house himself and she can rent and she will get help to pay the rent.0 -

£115 x 12 divide by 52 = £26.54 pw*SIGH*

has she closed the joint tax credits claim and opened a new one as a single claim - this should see an increase in the £20 child tax per month.

yes the 115 maintenance and the tax was a joint one .. she wasnt aware she could open another one.. she doing that as i type (on my phone lol)
She has been and is looking for a full time job, few and far between down here at the moment.. lots of companys shutting down and her part time job hours been cut.

She can only start a single tax credits claim once she has cancelled the joint one.
If she was to rent off him she would need a tenancy agreement and her ex partner would need to inform his mortgage company he is now letting the house out and they may not alow this anyway0
