pwc payback overpayments

hi just looking for some advice really if anyone can help that would be gr8....i am a pwc and i have just found out that i have been getting overpaid for the lst yr by my ex he had a new partner and son living with him apparently since may last yr and despite telling the agency this...(i had no idea) they hav only now decided to act on it after i asked for an account breakdown...it now transpires that i have been overpaid by the tune of £600 odd pounds which i cannot afford to pay back...they are asking me to pay it back and to be honest i cant afford for my payments to go down anymore they have already gone down from £60 a week to £30 just wondering if anyone knows if i have to pay it back seeing as for the last yr i have had to ring them every month to get my payments and tried to make sure i was not overpaid to avoid this situation...(my payments seemed to change every month) even tho ex had a deo any advice wud be appreciated....i owe roughly £600 now and think its unfair they want me to pay this back as it was clearly their fault for not acting on hte information my ex hadgiven them....i am not on benefits btw and am also not working thanks

    It's their fault, so you don't have to pay it back.

    Please get on to your MP, who should sort it out for you. It clearly maladminstration on their part. Something they are very good at...the only thing!

    Someone was getting my payments put into their bank account for a number of months and they didn't have to pay it back because it was not their fault...even though they must have known the money didn't belong to them.

    hiya thanks for that still not sure where i stand tho as have already agreed to pay £15 every two weeks, felt kind of pressured into it and she said basically if i dont agree to an amount htey can just take any old amount out of my money....where is this sticky link i cant see it lol

    Sticky is at the top of this forum. Get in touch with your MP....more info generally on sticky. I would be inclined to get back to this member of staff, mention maladmininstration ie it's their fault, and then to ask to be put through to the Complaints Resolution Team. State the matter is now in the hands of your MP too.

    hi just rang them and basically they said if i do not agree to a sensible amount they will just take what ever they want out of my ongoing maintenance....have just emailed my local mp and he replied very quickly i might add lol and said he will look into it so fingers crossed...

    It is right that they collect from ongoing payments - you won't be able to stop that. If however, there was no more maintenance to come, then you would not be obliged to pay it back.

    Was the person you spoke to your case officer and do you have their name? Did you ask to be put through to the Complaints Resolution Team?

    Get MP's assistant to phone up the Parliamentary helpline and I would also complain about this member of staff too. They certainly cannot take out what they want. Have a read about the Civil Service Code...on the sticky link.

    It will be the MP's assistant who replied to you, so give them a ring in the morning.

    You could always apply for the shirt of his gf's back aswell, as this looks like where this is heading.

    or he cud just pay what he is supposed to and then i would not have any of these issues if you have nothing constructive to add why post at all??
  • if an overpayment has been made they will take it back if there is ongoing maintenance, all they have to leave u eith is £5. and if he is receiving tax credits theses should be taken into account as per the rules, contact them to see if they have taken theses in to account and if not ask them to.
