    at first i didnt know anything untill me money didnt go into my account so i rang them the day after and tryed to get things sorted out
    Was this 3 months ago? What have you done since then? Waiting for them to complete their investigation is all very well, but you've run up debts while this is going on, and your LL has been without rent.

    You really could have been pushing for a resolution of whatever the HB problem is. Have you considered what you'll do if your HB is not paid? Maybe you need to consider all the options for the future.

    I have talked to my previous landlord and has a room to rent in the next few weeks.

    I just need to keep my flat until then thats why im asking if its illegal just to kick me out say tongiht with out notice

    It is illegal to just kick you out. He HAS to take you to court.

    Worst case scenario: if he starts chucking you/stuff out ... phone 999.

    Thanks hopfully it wont come to that. Ive just never had this happen to me before and im only 19 so its all new to me and i really dont like confrontation.

    Don't let him intimidate you, either. Sounds like he's borderline harassing you if he's coming round twice per evening! Do you have any friends who could be there with you when he comes?
  • As you are a tenant not a lodger then yes as other people have said it is illegal. Might be worth taking a look on your local councils website to see if theres anything about protection for tenants who get HB? Or just a general search on the net for tenants rights regardless of income status?

    I have a few freinds that come around at 5-6pm but after that they have to go and he normaly comes back at 8-9pm.

    I have been doing research on the net and says that for them to evict me they need a section 8 and also need to send me a letter saying im been evicted.

    so you have not paid the rent, nor do you seem to have chased up the HB office to get it sorted, and now you want to abandon the tenancy altogether leaving your landlord where exactly ????

    HB must tell you why they have cancelled your payments and they must do it in writing... dont leave the HB office tomorrow until you get this in writing...

    if they wont do this.. find out who your local councillor is and get his/her immediate help

    Because you are now more than 8 weeks in arrears, yoru LL must give you 2 weeks notice of his intention to go to court to have you evicted... then a hearing will take place which you must attend.. if you dont you will be evicted... if you can get HB to pay all your arrears before the hearing your LL cannot throw you out on a SEction 8.

    The only legal document which says that you will be evicted is the one issued by the court after you have been to the hearing.....

    if he knocks on your door twice a day he is harrassing you and you could call the plice but i think this may only make things worse at this stage....

    Yes - definitely a good idea if you can have a couple of friends/family members round.

    If you're leaving (by your choice) inside of the 6 months contract, make sure you have evidence that the Landlord agreed to this - so he can't chase you for the extra rent.

    The Housing Benefit does need to be sorted, though - get onto the council and, if things don't move quickly, ask your local councillor to chase it up. 3 months is pretty dire.
