PPI reclaim - am I too late?

I wrote to Lloyds about my PPI and they said no. Now that was in Dec 2008 and they said I have 6month to contact FOS but I didn't. Can I start again or am I too late? We are seriously struggling at the moment.


Should I try and contact Lloyds again or contact FOS?

  • i doubt the FOS will do anything with your initial complaint, however it would be worth writing to Lloyds along the following lines.

    refer Lloyds to the FSA's instruction in September 2009 for lenders to re-visit the 185,000 claims they have rejected sinse 2007 that did not get refered to the FOS. the Lenders have been instructed to do this because of the high numbers of complaints up-help by the FOS in the customers favour after the banks had rejected the claims.

    there is a real concern within the FOS and FSA that banks deliberately tried to ignore the genuine complaints of customers and fob them off, hoping the customer would not go to the FOS. (as in your case)

    I would write to Lloyds, refer to the FSA ruling and request that they re-vist your original complaint (send a copy of this if you still have it) as you feel that they had not dealt with your original complaint properly. also list out what the grounds of your original complaint were and ask them to re-vist each point.

    Request that they issue you with a full response to each point of your new complaint. If you then do not get a satisfactory answer it may then open the door for the FOS to look at it for you. it may work, it may not, but its worth a try.

    As long as you were mis-sold you are probably at least entitled to complain. If they have indeed deprived you of money through under hand tactics, then they are in no position to set a time limit on when you can reclaim it.

    Sounds like a typical tactic designed to dissuade you.

    the time limit of 6 months is set by the FOS not the backs - howver, there's nothing to stop anyone going back with a new complaint if the 6 months has expired
