    Yes to the first.

    Not necessarily to the second. If your EA has a good buyer base, and has been keeping track of who's been viewing/asking about their houses, they might have someone ready to proceed on your house before it gets anywhere near a website.

    What about potential buyers who don't have a computer?

    As said, That clause is NOT typical - Just find another EA with a no sale - no fee - contract -
    You are asking for trouble for the sake of a couple of weeks.

    Out of interest, did you go with this EA because they gave you the highest valuation of your house? There is a famous trick they use where they'll market your house at a high value to get your business, and then after a period of no sale (say 12 weeks) they ask you to reduce it to something more reasonable so they get a sale.

    yes and no.......they did give us a higer valuation but we said we didn; think the hse would acheive that and we would want to put the hse up for less then that - more inline with what the others had said.

    But more of the reason we went with him is because we are situated in the middle of 2 large towns - one slightly bigger and more money. We went for that reason as we think that is where our buyer is going to come from.

    If we change now - would we have to pay for 'time spent' by the other agent doing the photos and the floor plan?? we havn't signed anything.

    No. You've signed nothing so get out before you get trapped.

    1) They over-valued your property to get your business (and you had to adjust the price)
    2) They have an unfair T & C
    3) they are not addressing your concern on the T&C

    Read the signs and walk away. Yes, you'll lose a week or so, but you've learnt a lot so know what to ask the next agent from the start.

    Only question is about the HIP? Have you got one, and did you arrange it yourself or was it part of the deal with the EA? If the latter, by leaving them you might lose the HIP and have to get a new one.

    thank you G_M, great to have someone to sound off - things are happening so fast here, ive spoken to another agent already - the one who we should have gone fro in teh first place but didn't cause we went after the money in the big town!!!!!!

    he has agreed to put the hse on for the price we want - no sale - no fee - no get out fees....and will move immediately........

    now just have to ring and canx teh other agent - not looking forward to this at all - expect them to try make us stay.........

    oh and we got our own HIP.... luckily we foreseen that one at least lol!

    Phew ok spoken to EA and have cancelled with them.... 2 telephone calls and 1 email later i think they have accepted it.

    here's hoping we have better look with the next one!!

    is there such a thing as an honest EA....i hope so :)

    you know they never even suggested that......we did initially at the valuation and they said no straight away.

    the more i look at their contract the more horrible it is - we would have been trapped for weeks! they had EVERY angle covered.
