Dual Controls Driving Instructor

Hi,

I placed a deposit (£250) on a car in December last year for a driving school. Due to a few problems in starting up the business, I wasn't able to take delivery of the car and pay in full. Now due to a problem with the finance side of things, it looks like I'm going to have to lease a car rather than buy one.

I have informed the dealership where I placed the order on the car and apparently that have had dual controls fitted on the car and if I can't take delivery of it, they want to me to pay for the dual controls and I can have them. NICE.

This was an offer that Mazda UK had at the time where the pedals were fitted for free.

How do I stand on this legally? I haven't signed a single thing for this car.

    I cannot understand how you paid a £250 deposit but never signed anything, you are saying they took the money without an agreement, garages especially main dealers assuming this was one do not just take a deposit and then fit extras such as dual controls which are a specialist item without any paperwork.

    If you haven't signed anything I can't see that they can hold you to a contractual agreement.
  • I've just double checked the paperwork and I have a transaction for the deposit, but I haven't signed an agreement to buy the car.

    So if I haven't signed an agreement, does this mean I'm not liable for the fitting of the controls?
  • Just spoken to consumer direct and it seems that I am liable to cost of the dual controls fitting. As I paid a deposit, that is as good as a signed document.
