    Lets hope it'll be good news.

    (Do remember as far as a tax overpayment is concerned - you were overcharged and then refunded by HMRC - so the refund it is not a "windfall" and should not be taken by the OR).

    The HMRC redirected it to the OR in my case.
    Lead me not into temptation, I can find the way myself.

    Hi BA,

    That is a shame - it would have been much easier if you had got it.

    And strictly speaking the OR should have given it back to you - they may not have realised the refund was for an overpayment of tax.
  • Well im very dissapointed to say the least.:(

    After discussing my position and thoughts on my tax overpayment refund, I was asked to hand it over to my OR.
    I then protested over the phone and they then asked me to submit an explanation as to why I think I am am eligible to keep the tax overpayment refund.
    I did exactly that and I received a phone call today saying that I have to hand the lot over as it is an aquired asset!!!!

    I really do not understand how they came to this decision???

    Do I have any official means of complaint available to me before I write a £1000 cheque of MY OWN money and hand it over??????:mad::mad::mad:


    Any comments would be greatly appreciated.

    technically its not your money they'll be looking at it as an after aquired assett....even though its a tax overpayment sorry

    nothing to stop you registering a complaint with the OR who is in charge at the office dealing with your case but I very much doubt it'll get you anywhere

    for what its worth? I had a tax payment a little more than yours & I lost the lot.....also lost nearly £3000 with something else as well

    It does seem a bit unfair.

    Because you were effectively underpaid whilst you were charged the wrong tax.

    And then put back to where you should have been with the refund.

    In other words you would be no better or worse off - providing you keep the refund.

    Unfortunately you'll be worse off if the OR insists that you have to hand it over.

    Why not diplomatically explain this in writing.

    And mention that you do need this money for a new washing machine (that you said in post 3).

    I understand what you are saying and I did think there was a possibility that I may lose some of the money but not the whole lot!!
    Its very cruel having to hand over money you know in your heart is yours and it looks like youve had to hand over a fair bit too (including a car)??:(

    It is REALLY unfair. I worked hard for that money and its a kick in the teeth.
    I tried writing a very diplomatic letter to my OR and she took it to her boss who made the desicion to take the cash.
    She said it is because i shouldve been on a nil tax code anyway (which as you know, still hasnt been implemented) and as such would not have seen that money anyway which is absolute bulls**t!!

  • I totally agree LATL...if the OR at your office still refuses to discuss the issue with you then go above their head to the regional director for the area & see what they say

    I did loose a fair bit of money to be honest....thankfully not the car though as its a motability one the receiver couldnt touch..although didnt stop him asking had I considered sending the car back & making a voluntary donation to my creditors with the cash instead.....hmm right

  • Thanks for the valuable info phil, its a shame that theres no compassion sometimes! I mean, im an honest, hardworking person and this is how you are treated!! Its a joke!

    By the way, if I choose to go over their heads, is there a time-scale involved??
    The OR has told me I have to get the money sent in ASAP but with no access to a cheque book or online banking, I will have to draw the money out at £200 a day until I have the amount needed then get my dad to write a cheque for them.
    Do I send the money in to them whilst making the complaint to the regional director and if he decided to let me keep some or all of it, I get it straight back.

    Any clues as to what way I do this???
  • I think you can get the whole £1,000 out over-the-counter if you go into your bank with ID. (rather than the daily cash machine limit).

    What I'd do, is have the bank give it to you in 1p/2p coins and drop them all off at the OR's office :)
