I made a claim against an online casino who are not paying me my winnings due to me apparently breaking their Ts & Cs. I made a claim via money claim online, the casino responded saying they would defend the case and apparently a directions questionnaire was sent to me which i didn't receive. i have now been told that the case was struck out because I didn't complete and return the directions questionnaire. To reinstate the claim i have been told that I need to complete form N244.
I am unsure what to write in section 3 (What order are you asking the court to make and why?) - I have written 'to reinstate my claim which was struck out due to me not returning the directions questionnaire which i didn't receive'.
Section 4 (Have you attached a draft of the order you are applying for) - I am not sure whether i need to attach a draft, if i do, what would i write? Would I go into why i made the claim in the first place or why i want the case to be reinstated?
Section 10 (What information will you be relying on, in support of your application) - What should i be writing here? Should i write the evidence that i had not received the directions questionairre? (although I can't prove that I haven't received it) or should I be writing the evidence of my original claim ie. that the casino has not paid me my winnings?0 -
