Rights regarding returning goods for refund

Hello,

I was hoping for some advice on my rights regarding the refund of a credit note from a shop. Here's some background info;

I purchased a jacket from a motorbike clothing shop in Dec '09. The jacket was part of a two piece outfit with matching trousers. At the time I purchased the jacket, the shop didn't have the matching trousers in my size (I only paid for the jacket). The shop said they would order the trousers in for me. I duly received a call from the shop a couple of days later saying that the size I wanted was not available. I visited the shop to discuss the situation and discovered that the 2010 version of the jacket & trousers did have the correct sizes that I was looking for. As such, I returned the jacket and was issued with a credit note for the value of the jacket with the agreement that I would exchange for the 2010 kit when it arrived.

The shop called the supplier regarding delivery dates for the 2010 jacket/trousers and was told they would arrive in Jan 2010. I was happy to keep the credit note as I expected to wait only a few weeks before I could collect the new jacket/trousers and it saved having to refund to credit card.

However, I have just spoken with the shop and their supplier has said that the 2010 kit has been delayed and will not arrive until late March 2010 which is after the date originally promised and after when I need it for a holiday trip.

The shop is refusing to refund the credit note despite being unable to supply the goods within the timescale originally discussed. I still have the money in the form of a credit note, but I need this money to purchase goods from elsewhere to meet my travel deadline.

I would be grateful for some advice about my rights regarding obtaining a refund for the credit note? Also, is there anything that I can quote at them to make them change their minds? e.g. SOGA, etc.

    Can't see that you have any rights legally. It's not their fault the supplier let them down. Ultimately you should have waited for both parts to arrive until you paid anything.

    Looks like more of a gentlemen's agreement rather than anything legally binding so put up with it im afraid!.
    Back by no demand whatsoever.

    If the products cost more than £100, you may wish to talk to the relevant credit card company.

    Wouldn't have thought so. As previous poster said OP should have waited.

    I'm a little surprised though that the shop is playing hard ball as this is hardly likely to generate returm custom.

    OP have you spoken to the manager/owner/head office etc?

    as you bought the jacket and then changed your mind about it, then legaly they aren't obliged to do anything for you I'm afraid...
