whats the worst they can do?

Im having continues talks with call centres who ring me 4-5 times a day regarding my credit card debts who tell me that if I don't make a payment my credit file will be affected or someone will call at my home.

I own nothing, i rent my house, I'm self employed and I'm earning very little, what I do earn goes on the rent gas electric.

I'm starting to get a very militant attitude, where before when the callcentres called I carefully explained my problems but then the next day they would call again and I would have to say exactly the same thing. this has been going on for about 6 weeks with 4 different credit card companies,

I feel like just telling them to get stuffed!! let them take me to court, I know my credit rating is sunk I'll show the courts how much I earn

if taking me to court is the the worst they can do then to be truthful I don't care. I can handle phone calls and the stress of my situation

sorry if this is a bit of a rant but today I had a moment of clarity were I realised the best thing in my life can never be taken away from me!!

    Are you saying that you have no Credit card debt but they call you by mistake?

    If so then let them take you to court, it's there faces which will have egg on them come the court date

    Take a look at the above thread. You can write to them and ask them to stop calling; that you only wish to communicate in writing. it may take them a while to get the message but they should recede at least.

    You can ask them to proove you owe the debt. Ultimately, if you do owe it, they can take you to court and issue court bailiffs to reclaim what they are owed taking anything you own (ie. laptop, phone, ipod etc, if you don't have assets like a house or car). They can't take anything that you can proove is owned by some-one else.

    Chances are your crdit file already looks bad- if there's defaults, they will remain there for 6 years making it difficult to obtain any kind of credit and even phone or utility contracts.

    I understand you are frustrated by the amount of calls you are receiving, and I suspect they have been none to pleasant, but you do need to do something to try and sort this out as it won't go away. Use the letters as a starting point and come back with your SOA and any other questions if you hit a stumbling block.

  • mick, try not to panic too much hun, the fact your self employed should prove to them that your very limited to what they will get. Cant you block their number or change your phone number. Are you still struggling to do a SOA being the income since mid december? ive got my fingers crossed for you that the weather improves for you, then hopefully you should get more work about. Mick i know you say you can handle the calls, but you shouldnt have to really. stay with the positive attitude. :)

  • sorry I should have been clearer, yes I owe the credit card companies money they are quite justified in calling me about payment, but in the beginning i careful explained I was self employed and had very little work so at the moment could make any payments, but one company seems to work to a set script which after I have explained my problems they start over again from the beginning as if my explanation was'nt heard.

    from my research on the internet if they take me to the county court the court will look at my finances and make me pay an amount I can afford. court bailiff will only get involved if I go against the courts ruling and don't pay.

    but I agree this won't go away like i said the call are getting a bit irritating ( although funny at times).

    Cookie I can change my number as its the work number,

    my SOA will be coming soon but like I said in a past post it will look like I'm living on fresh air until i get some more money coming in
  • try sending them this:
    Send them this harrassment by telephone letter to all creditors addresses. Send it recorded delivery for your records:

    Dear Sirs
    Harassment by telephone

    FORMAL COMPLAINT UNDER THE CONSUMER CREDIT ACT 2006 COMPLAINTS PROCEDURE

    Account Number: XXXXXXX

    I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

    I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)

    I now require all further correspondence from your company to be made in writing only.

    I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.

    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)
