Advice for newbie's friend re phone charges

I'm trying to advise my friend, and thought maybe someone on here could offer me some advice. My friend received a phone call some months ago and agreed (on the phone) to try an alternative phone provider as the information given was that it would be around £5 cheaper per month than BT. No contract was signed. No monthly bills were issued - friend had to chase up, paying for the privilege of being on hold a long time until phone was answered. The bills have been far bigger, and although friend rang to terminate contract, is still receiving bills, despite the phone being cut off the day after requesting termination of contract. One of the bills has been paid as friend not wanting to have anything against name for non-payment. Surely this is wrong, particularly as no contract was signed, and the company seem to be failing on their part to provide monthly bills or correct information re charges.
Please can anyone advise, or has anyone experienced similar and managed to reclaim money they had paid?

  • You don't need to sign something to have a contract. Contracts can be verbal. The contract was probably subject to distance selling regulations enabling cancellation/reversal within a certain period but that option has probably expired now, particularly as the first bill has been paid and the service is up and running. When you can cancel depends on how long the contract lasts.

    Euphony phone is a 12m minimum term contract. By accepting the service your friend has agreed the T&C's. No written contract is required, as a verbal one exists and has exactly the same legal status.
    The early termination charge will normally be the balance of the 12m line rental and call package fees, so it was a bit silly cancelling, as they will then be paying twice over.
    They should have seen out the minimum term and then moved elsewhere.
    No free lunch, and no free laptop ;)
