Can I sell my unused software

The hard drive on my laptop died recently and a friend put in a new hard disk and set me up with a 'temporary' copy of Windows XP and Open Office as I bought the laptop second hand and didn't have the original disks.
I bought a copy of Office 2003 Pro and Windows XP but have decided to just buy a new laptop and haven't used the software and it's still in the original packaging.
I was wondering if I am allowed to sell the software on ebay. One of the disks is OEM and another is the retail version. I see that there is loads of software on Ebay but I wanted to make sure that this is perfectly legal. Given that I bought a license rather than a product, do I have the right to sell the licence?
Any advice much appreciated.

Slightly confused by this.and set me up with a 'temporary' copy of Windows XP
As for the rest, take a look perhaps at what the terms and conditions say on eBay

The OEM software cannot be sold on, it "lives & dies" with the machine it's first installed on. The retail version can be sold0

By 'temporary' He must have used another disc that he had but Windows Genuine advantage keeps popping up on my screen!
