Does anyone know who can lay claim to a will? My friend's mother-in-law is unfortunately very ill. She has not left a will as she assumes that it will go to her next of kin equally. However my friend has three children and her brother has none and has never wanted them. My friend does not get on with her brother and his wife. The Brother and his wife are extremely wealthy and own 4 detatched properties which they do not even rent out. Therefore when the Mother dies she does not know whether her 3 children could also lay claim to the will as they are her grandchildren. Does anyone know ?

    There is a very strict pecking order for intestacy.

    Thanks for your reply. This seems to indicate that her estate would be shared only between her children and not her grandchildren.

    Sorry to hear about what's happening. Just goes to prove that EVERYONE should make a will!
    A lot of young people with kids don't realise that if they both died, their children would be taken into care and then the state decides who has them, if there is no will!
    Most people you ask say "Oh my mum/sister would have them" but it doesn't work like that.
    Also if you get divorced or re-married, you must make your will again, because they become invalid.
    As soon as I was divorced, I re-made my will, because I didn't want my kids to go to my ex and his tart to be brouht up if anything happened to me, so I organised guardians, and made sure my estate (What little there is) was shared equally betwwen the children.
    Now it's done, and I can forget about it, but there is so much heartache if you haven't made a will.
