Fitter damaged wall & wardrobes!!!

I was just wondering what you would do...

I had a stair and bedroom carpet fitted in the week, the fitting was subcontracted and the guy was obviously on a price..

I'd cleared the room except for the wardrobe as they physically wont come out the room..
I told the guy to give me a shout to help him move them as one was a bit wobbly and would probably collapse...

Well 2.5hrs later, I heard an almighty crash.....I did say why did you move it on your own. did nt really get an answer....so he stacked against the wall, and I left him to it..

5 mins later he came down and said...right I'm done...I was so annoyed and upset I just paid him...( stupid I know)

I went up stairs....well...he'd left all the waste carpet and rubbish in a pilein the corner of the room....all the little off cuts of pile...were still all over the carpet....and I notices that on one side the skirting board had come away from the wall and with it cracked the paint up the wall...which was only painted at the weekend...

I phoned the company...the bloke who quoted me said...ok i'll get the fitter to come back....I said whats the point..is he gonna rebuild my wardrobe and refix the skirting board and repaint the wall....he said he'd call me back..

Next thing the phone goes it's the fitter....he said he's never tidied up !! that he doesnt get paid to hoover up.!....he's on a price, and he was sorry about the wardrobe and hadnt noticed any damage tothe wall...

I didnt stop the cheque as I think it would cause more grief than its worth, and actualy the laying ofthe carpet and the carpet it's self is ok..

Just wondering what my rights are...I did take photos which I thought about sending to him recorded delivery andking him how he intended to reimburse me for the damage caused?

What do you think or should I put a stop on the cheque and wait for him to contact me?

    So you knew the wardrobe was knackered before he started, you were quite right it did collapse. How do you know it wouldn't have done so if two of you had moved it. Sounds like it was an old MFI one where you screw into the end grain of chipboard and you're better off without it.

    Get the paint brush out and touch up the skirting board.

    No carpet fitters remove the offcuts and hoover up as standard, they will normally bag it or leave it in one pile in the room.
    The other damage is down to them, though they might try and wriggle out of it on the grounds that you are supposed to clear the furniture yourself.
    But it does sounds like your wardrobe was an accident waiting to happen if it's that fragile.
    No free lunch, and no free laptop ;)
  • The carpets fitters that have been to my house over the last 30 years have always taken away all the rubbish.
    Mainly because I firmly ask them to do so.
    Oh and I always check the room and the carpet before they leave......common sense to do so.

    Write to the company you paid to do the work. Your contract is with them. They are responsible for the sub-contractor.

    Ask them to put the wall damage right within 'x' weeks, or you will employ your own tradesman and send them the bill.

    This is why we all have to have insurance before we work.

    Chippy - Yes it was knackered....but it was still standing and if as I asked he had got me to help then I am 99.9% certain it would still be standing. I was 100% sure that if anyone tried to move it on their own it would collapse.. If it had gone when we both lifted it then well so be it...It's just I had warned him and specificly said to come and get me downstairs to try to avoid it collapsing!..and yes its an old MFI one...

    I'll write to them with piccs and see what they say, I still think its bad custimer service to a) pass me to a subcontractor and b) not callme back to see if my conversation with him resolved things...
