not sure if i can reclaim- help!

two years ago I began the process of reclaiming just over £5000 of bank charges and like most was put on hold. I have received a letter from the bank saying the recent test case provede they are right and I've no entitlement to a refund. The account in question is closed but I am in financial hardship and have 800 of mortgage arrears and reduced payment agreements with virtually all my creditors. During the cycle of repeated AND EXCESSIVE BANK CHARGES I took out extra borrowing and extended credit limits where possible to live! My argument is that many of these loans and agreements are still in place and had the bank been more supportive and not charged me every month (sometimes three or four charges which of course meant DDs unpaid and so charges there as well) I may not still be in financial hardship. From what i can gather the bank will still refuse and FOS will not look at case because the account was closed- is this right? Can i still try to reclaim?

I.m currently with nationwide and they have been very good i've had a few charges but it's a basic account- cash card/dds only and no overdraft. i did contact them about charges and they refunded so no complaints with them- i just don't see why i should have to forget about the charges levied by previous bank because the account is now closed- especially as they amount to just over 5000.0
