PPI claiming- can anyone help?

Its been approx 5 years since I took out a mortgage protection insurance for illness and sickess etc to cover our mortgage which we had just taken out.
As far as I was aware we took out this to cover both myself and my partner if we were off ill from work.

I tried to make a claim on this after being off work for several months, with what was suspected as cancer but luckily wasnt in the end.

I was totally shocked to find they wouldnt pay me out anything after contacting everyone they could, they decided I was fit to work (even though my GP gave me sick notes which I always to forwarded to them ad said I was not fit for work)

This was through legal and general and was sold to us by a mortgage advisor.

I am able to claim a mis-sold policy on this?

    Hi There. It is quite usual to have protection on your mortgage and is a sensible thing to do. Saying this perhaps you could explore further why they would not pay out. Do you have the paperwork still. What reasons did they give. If they sold a useless policy then you could try to claim it back.

    Could you give more details?

    Hi, sorry to hear of your troubles with claiming. What reasons for being off work were actually on your sick notes from the doctor? Was it perhaps a stress related problem as you had not actually been diagnosed with anything? If this is the case sometimes "stress" illness's are not included in the cover or something similar like depression. You would have to check your terms and conditions of the mortgage perhaps.
  • I cant remember exactly what my sick notes said, however my doctor did also write to them stating that I was unfit for work. It definately wasnt related to stress, it was for a large lump which I had on my body which was painful and being investigated. (the doctor gave the medical name for it on sick notes)
    The reason legal and general gave to me at the time, which I disputed but they wouldnt cooperate was that they had wrote to the cancer specialist doctor at the hospital and he said it wasnt cancer and that I was fit for work in his opinion.
    Other specialists I saw disagreed and so did my GP but legal and general werent interested in their opinions.
    At the time I also had a PPI for a loan with the HSBC. They paid out no problems for the full length of time I was on the sick.

    Hi again, did you state that you had cancer to legal and general? I know it sounds hard but even people "with" cancer are sometimes fit for work as to be unfit, you have to have something that is stopping you. (ie be receiving chemo that is making you sick or something similar.) Most people that are awaiting tests for cancer are actually given a sick note for "stress" related problems arising from the thought of having cancer if you see what I mean. If your doctor put that you were actually unable to work because the lump was restricting you from working then this would be acceptable but not from worry form the lump which would be stress related usually and can sometimes be ommited from making a claim. Depression is also something which you cannot usually claim for also UNLESS you are receiving psychiatric help from an psychiatrist or trained doctor.

    Perhaps your best bet here would be to go over your terms and conditions and see that you were eligible to claim and then take this up with the insurers and get the doctor to actually state again why you were not fit for work. I hope it works out for you.
