guarantor

Ny mother was guarantor on my car. I was made redundant and fell behind on payments. She kicked me out. Ended up in hostel for 6 months. I dont get much in benefit left after paying the essentials. I dont know who is liable to pay now. Car repossessed with £1500 outstanding. She wont pay and is sending solicitor to recover money from my benefits. I have no paperwork. Where should I start?

    she is as liable for it, although does not stop her getting it from you the legal route
  • Cant pay. I was left with nothing. She knew I had problem with drink and when she kicked me out I could not get any support. They would not treat me in hostel. I woul love to pay it just to show her I can but that would mean real hardship. She cut me off and out her will. I am not bitter but she knows this. I have dragged myself back up and am sober but can't face more money taken from me.

    Is the value of the car equal or greater than the outstanding amount? Could you sell it to repay her or hand the car back if it was on HP?

  • The car was repossessed. I anonymously told them where it was (outside hostel) cause I hadn't got money to put petrol in it to take it back. They must have valued it much lower. I have no paperwork as she kept it all. I dont know what has gone on with the car since.

    she will need to go to court to get a CCJ againat you and then an enforecement order

    a judge will not give an enforcement order against your state benefits as they are deemed to be the minimum to live on.
