Car accident - who's at fault?

Either the OP's account of the incident is wrong or the guy on Chapel Hill was speeding... there is no other explanation!
I don't even think the OP was there.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -

Probably true
But then when has that ever stopped a good debate?

But you can't do anymore than edge out & look, if the road is clear then you will carry on!
We are just going around in circles, the OP's Dil emerged in the path of a car travelling on the major road and there was a collision, any way you look at it, she should never have put the car in to that position.
She did not take adequate observation before emerging. end of.
Now I think I have put enough in to this thread and only received insults from the OP who obviously does not like the facts, so I will move on now.0 -
Is the OP dj's mom?Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0

Hi OP
I just wanted to tell my story of a similar situation.
My uncle was killed a few years on his motorcycle in a very similar situation to what you are describing. He was on a national speed limit road (the godawful road to Barrow!) and a car pulled out and he was hit and killed instantly. After a year of being investigated it was decided that the women who's car hit him was not at fault. My uncle was travelling at over 100 mph and the junction was a blind one, the driver didn't stand a chance seeing him, he literally came out of nowhere.
Its not always as clear cut as saying the driver pulling out of the junction was at fault as I now know. I know its an extreme situation, but at the inquest my uncle was deemed as being at fault, not pleasant, but all my family believe he was in the wrong to speed so fast and put others at risk.:heart2: Newborn Thread Member :heart2:

Firstly, I am sorry to hear about your loss.
Secondly, thank you for bringing this up. This is eactly the sort of situation being discussed here, a person going too fast in a low visibility situation.
However I do agree with one thing the people blaming the OPs dil are saying. The insurance companies probably will blame the dil, or go knock for knock as they will not bother to spend the time and effort to investigate this the way the police did in your case.0 -

Thank you. I agree with most of the other posters too, just wanted to give a different slant on things. The police probably won't investigate as they did into my uncle's death, but I just wanted to show that things aren't always clear cut. There can be exceptions as in my families case.:heart2: Newborn Thread Member :heart2:

I'm not sure of the exact spot, I know there are alot of people killed on that road every year though, I think there are signs up with the statistics on.:heart2: Newborn Thread Member :heart2:

Very sorry to hear about your loss
but your story confirms what I have been trying to say... making a sweeping statement without taking everything into account is nonsense. Always try to be at least half the person your dog thinks you are!0 -
I'm so sorry to hear about your loss Jannine.
Thank you for posting your comments.
