I sent a complaint to the financial ombudsman about the volume of calls I received from cap 1 when I had requested a repaymant plan, including them ringing me and then ringing me again 5 seconds after I just hung up the phone to them on numerous occassions and sending me threat txts on xmas day.

(I owed £200 balance on the card. I paid towards the card every month just not the full amount)

The result of the complaint is the ombudsman have sided with crap 1 and say they are within their rights to do this. Has any1 else been harrassed by capital one? I would just like to know of your experiences.

    i think the complaint about harrassment should be to the fsa the ombudsman is a waste of time he is wrong

    It's a lady dealing with case, I even listed all the calls and was told I was in the wrong for blocking many of the numbers they rang on.

  • They respond very well to the letter you can send about phone calls. I have to say once they received the letter ( make sure they have to sign for it) then they rung up once to say they had got the letter and took the complaint seriously.
    Blackadder: Am I jumping the gun, Baldrick, or are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation?

    No you aren't you pay for the phone therefore you can choose who rings you and who doesn't.

    Send the letter and don't answer them. Turn the ringer off if you can. They can ring, but at the end of the day it achieves very little in terms of productive conversations, especially if the call centre is abroad.

    I already sent the complaint and the ombudsman dealing with my case said 'the calls were not unusual or excessive,particulary as you did not answer the telephone to capital one and proceeded to block numbers from contacting you' I musthave answered at least 100 calls to them repeating myself, not including the ones I didn't answer!

    NEVER EVER talk to these people on the phone there will be someone who will advise you on what letters to send soon try not to wory you are among friends here and will get verry good advice

    Me and OH had similar problems with Tesco, Halifax, M & S and Capital One. The calls were never ending. My OH was also getting calls on his mobile from M & S.
    Yes we're deep in debt and know it but the number of calls we were getting was beyond belief and stressful. In the end I wrote a letter to M & S re harrassment and the template for it is somewhere on this site so I hope someone will be along to help locate it should you want it. That stopped all the calls from them. I did however, change our landline phone number which obviously stopped the rest.
    I called the CCCS today as Halifax were wanting me to ring and update my details re phone number. CCCS said that there is no need for them to have your phone number providing that they have a way of contacting you and your address is more than adequate so that they can do so by letter.
    We're on a DMP with the CCCS and, I was told that should a creditor ring them for info then they will not give any to them other than your postcode.( data protection )

    Hope you get it sorted.

    I've edited my above post as I've already sent complaint to crap 1 had their final response, sent letter to ombudsman and they have come to the conclusion cap 1 were ok to ring and contact me so often.
    They even say I didn't answer phone-though I wrote times and dates of calls I answered to cap 1.

    I would like everyone who'sbeen harrassed by cap 1 to comment on here as I'm sure they've done it to more than just me.

    I also requested all contact in writing due to the volume of calls, they wrote to me telling me they had deleted my number from their records, then continued to ring and asked my phone number as a security question! Ombudsman also couldn't see a problem with this!
