    we have a written contract with a solicitor for the 5 years.
    the landlord owns the property outright with no mortgage so doesnt need to inform anyone and has registered as a landlord and as there is no income he doesnt have to declare anything...according to the solicitor

    Just claim CTB and put n/a (not applicable) in the rent box.

    If you wish, you could put an accompanying letter in saying that you don't wish to claim LHA, just CTB.

    Many homeowners have to do this to claim CTB. It's not unusual.

    There is either a rental income (albeit waived for work done, paid in advance, paid irregularly, whatever) or not. If there is no income, there is no rent, right? So no claim.

    To declare that you are paying rent when you are not would be fraudulent.

    Please be aware, the issue of the spent capital will be raised on your claim for CTB claim also and may exclude you.
  • Claiming CTB will not be a problem, if you are asked about the depreciation of your capital from the sale of your home then you just show where your money has gone...
    Its also worth noting that any capital from the sale of your home can be disregarded for up to 26 weeks anyway (if you had it!!)

    I may not have explained properly but I really didnt want to do anything immoral or fraudulent.
    We made £26,000 on the sale of our house (sold it for £89,000 not £200-250k) and that paid for the shell of the extension and the inside would be done by us as wages come in.
    we have 4 kids so a 2 bed flat would be a struggle.
    There are no savings in the bank and the wage coming in is £1100 a month.
    sorry if I have raised any hackles it was not my intention I was not actually wanting to claim the rent part, just the CTB but it is all part of the claim form and was struggling how to put the right thing in the right box

    This may be treated as deprivation of capital, so you would be looked at as if you still had £26K in the bank, you wouldn't have needed to spend that much on 'normal' rent. If your landlord does not have consent to lease from his lender and gets repossessed your five year agreement is worthless.
