    Said its a decree absolute now!!!!
    Also said it wont get to court!!!!!
    £100 for the letters to deal with it!!!!
    Did solicitor not mention the financial settlement at all? Absolute might not be awarded unless one is in place. I hope I am not worrying you unnecessarily, but I do not know how experienced a divorce lawyer you are using.

    Another worthwhile thread, but here's my brief input ...

    In the eyes of the law if a woman conceives or has a baby while married to one man, that man is responsible for that child, regardless of DNA test, etc. If they're married, he's liable. This is why the CSA were able to ruin so many lives for so many years.

    Clean break settlements are absolutely essential to stop things like this happening. If a solicitor doesn't suggest it, they're being (IMHO) derelict in their duty. Mine suggested it AFTER the divorce ... because it meant she could earn more money ... Sigh.

    OP may be lucky, or it may depend on the residing judge, and that could depend also on that judge's own personal circumstances and if their cat got run over recently, or anything.

    Its going to happen soon......as DP has asked someone from the commisioners office for child benefit to come out to the house and see for themselves that his eldest son is living with us!!!:j
    Plus we are gonna spend the £25 for a solicitors letter to go to the CSA so that the fruadulant claim can be stopped ASAP

    But its going to be one of the first questions that I ask on friday!!

    NAR---- there were no fiancial assets in the marriage! No house, No Car nothing zilch........he worked to support his family and at that time she was claiming income support......I must stress at this point DP didnt know about this until after they had split up........This can be proven:)
    My DP asked for pics of his kids growing up and his books back.......she sent a solicitors letter stating she would be keeping the books and comics for the benefit of the children.....she later sold them on ebay...partners son was witness to this and asked her not to..........she then said that she would give the negatives of pics of the boys....they never materialised, she has however sent pics of their wedding by email and pics of happier times in their marriage by email but none of the boys as children!

    In our favour, she has put the real dad on the birth certificate:D she is using the surname she took at marriage to save any embarassment to the child.........and probably herself!! So she cannot claim CSA from my partner for her 3rd child!

    I think you may be right on your point about thr judge getting out of bed on the wrong side.......I suppose if it all goes (for want of a better word) tits up then there is the option to appeal.......I think:question:

    Its such a bad situation, like really.......I always thought divorce meant that you should never see the other person if you didnt want to......and whilst there are kids involved I know some sort of contact is necessary:D....Its sad really that it cannot be more amicable, but our legal advisors are asking us to consider taking out an injunction on her so that she will stop contacting us via ..... my children through bebo/facebook.....(we had to report her for making up one on my behalf and using it to con my kids into thinking it was me.....then DS1 said wow mum why do you use such bad words on your bebo when we are not allowed to?) She has had numerous chances to stop harassing me in particular even a few quiet words from the police, who suggested taking out a non mol against her! (I didnt want to at the time as I didnt want it to affect my DPs children...as she told them I sent the police to take her away!!)

    Some people are complete and utter nutters! And the thing is noone can prove it.......although i do have witnesses, its scarey what some people can get away with!
