i need some advice on this problem please.
i was previously a bt customer at my old address and when i moved address in 2004 i change my address on the bt account and continued to be a bt customer till about 2005 when i changed supplier. i received my final bill and paid this in full and never heard from them again.
Last october 2009 i received a debt collection letter stating an outstanding balance from my previous address was owing which i enquired about and bt didnt seem to be able to resolve the issue as the account was 5 yrs old i was even told by bt that my account was clear and no outstanding bill was due.
After 7 attempts at getting this sorted with bt i was told that the historical archive file would send me a duplicate bill from 2004 which i have never received.
Since last october i have not heard from bt or a debt collection agency until today when a rather abrupt man called me from another debt collection agency demanding payment and when i refused he has said that legal action will now be taken against me.
i phoned bt afterwards and i have been told that they cannot access my account as it is too old (6 yrs) and they will request another archive bill to be sent to me.
what action will the debt collector now take? and if bt do produce a bill from my old address which i cannot prove i have cleared will i have to pay it as it is 6 yrs old now?

You may find this page useful, specifically:Statute Barred
A debt is considered Statute Barred if a creditor has not contacted a debtor for a period of 6 years and no action has been taken on the account.
Although the debt is still legally acknowledged as being owed, the creditor is not able to take any legal action against the debtor in order to recover the debt. It is considered unfair if a creditor or debt collector misleads the debtor into believing the debt is still legally recoverable. It is also considered an unfair practice if the creditor or debt collector press for payment after the debtor has stated they will not be paying the money owed. This could amount to harassment contrary to Section 40(1) of the Administration of Justice Act 1970.
